The court procedures are designed to save litigants time and money by making the 151<sup>st</sup> District Court’s expectations and requirements clear. <b><u>You</u></b> are responsible for knowing and following these procedures. The court procedures are clear and they will make your experience in the 151<sup>st</sup> District Court more efficient. The Court views them as the best practices for the litigants and the Court to work as a team to best achieve justice. </span></p> <p style=\"line-height: normal;\"><span style=\"font-size: 12pt;\">Note: The listed procedures are not to be considered legal advice. </span></p> <p style=\"line-height: normal;\"><span style=\"font-size: 12pt;\"></span></p> <p style=\"line-height: normal;\"><b><span style=\"font-size: 12pt;\">FILINGS AND COURTESY COPIES</span></b></p> <p style=\"line-height: normal;\"><b><span style=\"font-size: 12pt;\">All documents shall be filed electronically through efiletexas.gov except as permitted by the Texas Supreme Court's e-filing rules effective January 1, 2014.</span></b></p> <p style=\"line-height: normal;\"><b><span style=\"font-size: 12pt;\">File your motion or other document with a certificate of service, (include certificate of conference as required by the TRCP) and a proposed order each time you ask the Court to grant or deny relief. Please index your exhibits. Once you have scheduled any hearing date with the court clerk, follow up with a notice of oral hearing or (if applicable) notice of written submission.<br> <br> <u>The Court no longer accepts paper courtesy copies or e-mails of courtesy copies</u>. Instead, if a party wishes to bring a particular filing to the Court's attention, the party may (1) file the document electronically with the clerk's office as it normally does and then (2) call the Court to bring the document to the Court's attention, and ask the Court to view and consider the document that is already in the Court's electronic file system. Business attire includes a suit or comparable professional courtroom attire customarily worn in a trial court. Men are required to wear a tie. Please make clear in your motion and proposed judgment whether the judgment will be final (disposing of all claims and all parties) or interlocutory (partial).</span></p><p><span style=\"font-size: 12pt;\">Please submit the proper non-military affidavit by visiting the Defense Manpower Data Center’s (DMDC) Military Verification service at<a href=\"https://scra.dmdc.osd.mil/\"><span style=\"color: rgb(13, 110, 253);\">https://scra.dmdc.osd.mil</span></a>. </span><span style=\"font-size: 12pt;\">A Certificate of Last Known Address must be filed.</span></p><p><span style=\"font-size: 12pt;\">If the defaulting party was served at an address different from the one listed on the citation, the movant must file a Motion to Amend Citation. This motion should request that the citation be amended to reflect the address where valid service was achieved and should include a proposed Order to Amend Citation.</span></p><p><span style=\"color: rgb(33, 37, 41); font-size: 12pt; font-family: &quot;Times New Roman&quot;;\">If you are requesting damages or fees, the Court requires you to provide exhibits to prove up the damages sought.</span></p><p><span style=\"font-size: 12pt;\">When seeking attorney’s fees in a motion for default judgment, the movant must include an affidavit providing competent evidence to support the claim. At a minimum, the affidavit should address: (1) counsel’s experience; (2) the work performed in the case; (3) the time spent performing that work; and (4) the hourly rate charged.</span></p><p><span style=\"font-size: 12pt;\">The Court requires the movant to provide defaulting parties, as well as any other parties who have appeared in the case, with 10 days’ notice of the hearing and the default motion. Notice must be sent via regular and certified mail, and the movant must certify this action in a certificate of service. </span></p><p><i><span style=\"font-size: 12pt;\">*Special Note Regarding Homeowners’ Association Defaults</span></i></p><p><span style=\"font-size: 12pt;\">The Court endeavors to work cooperatively with Homeowners’ Associations and property owners in judicial foreclosure matters.</span></p><p><span style=\"font-size: 12pt;\">Motions for Default Judgment based on unpaid assessments or deed restriction violations must be set for oral hearing. A board member or property manager is not required to attend the hearing.</span></p><p><span style=\"font-size: 12pt;\">It is not necessary to submit the Association’s complete declarations. Only the lien foreclosure provisions are required for the Court’s review. As an example, if a plaintiff obtains a summary judgment as to one of multiple defendants and severs the disposed claims against that defendant into a new cause, that severance order will start the appellate timelines because all claims in the new cause will be resolved as to all claims and all parties. The court is currently denying continuances in older cases or granting one relatively short continuance.</span></p><p><span style=\"font-size: 12pt;\"> <br> <b><u>First&nbsp;</u></b>and&nbsp;<b><u>second&nbsp;</u></b>agreed continuances should be filed as a Rule 11 Notice. Please include the reason that you are requesting a continuance as you would in the motion.<br> <br> It is the court’s policy to expeditiously move cases to trial. Therefore, if the court notes that trial preparation is not proceeding on schedule, the court may set the case for an in-person status conference and assist the parties in overcoming any obstacles. Then work with opposing counsel or pro se parties to narrow those issues by agreement. As you can imagine, the court will frown on having to consider 40 different limine points while the jury panel is waiting on the hall. When preparing video deposition excerpts to play at trial, remember that some portions may be excluded under the Texas Rules of Evidence, and be prepared to present only the admitted portions without having to stop and start the presentation repeatedly in front of the jury. This may mean being prepared to edit the video deposition quickly during the course of the trial. Further, please edit the video depositions to remove long pauses between questions and answers, etc. This will save time in hearings and trial.</span></p><p><span style=\"color: rgb(33, 37, 41); font-size: 12pt; font-family: &quot;Times New Roman&quot;;\"></span><span style=\"font-size: 12pt;\">B)&nbsp;<u>Depositions</u></span></p><p><span style=\"font-size: 12pt;\">Provide page/line for any witness anticipated to testify by deposition PRIOR to the docket call. Opposing counsel must promptly advise of any objections. If objections remain, then the party seeking to exclude the testimony should file a motion to rule on the objections as soon as possible so that the court can promptly rule on the objections prior to voir dire.
